1. INTRODUCTION
These Terms and Conditions (“Terms”) govern all services provided by Anubhaw Enterprises (“Company”, “We”, “Us”, “Our”) to its clients (“Client”, “You”, “Your”). By accessing our website, requesting services, or entering into a service agreement, you agree to be legally bound by these Terms.
These Terms are divided into two sections:
- Part A – Domestic Clients (India)
- Part B – International Clients
PART A – TERMS FOR DOMESTIC CLIENTS (INDIA)
2. SERVICES
Anubhaw Enterprises provides services including but not limited to:
- Website Design & Development
- E-commerce Development
- UI/UX Design
- Website Maintenance & Support
- Performance Optimization
- Custom Web & Digital Solutions
The scope, timeline, deliverables, and pricing will be defined in a written proposal, quotation, or agreement.
3. ACCEPTANCE OF PROJECT & PAYMENT TERMS
- A project commences only after written approval and advance payment.
- Standard payment structure:
- 30%–50% advance
- Remaining amount upon milestone completion or before final delivery
- Payments must be made in Indian Rupees (INR) unless otherwise agreed.
- Delayed payments may result in suspension of work.
4. CLIENT RESPONSIBILITIES
The Client agrees to:
- Provide accurate content, images, credentials, and approvals on time
- Ensure they have rights to all materials provided
- Review and approve deliverables promptly
Delays caused by the Client may extend project timelines.
5. REVISIONS & CHANGE REQUESTS
- Revisions are limited to those agreed in the proposal.
- Additional changes outside the scope will be charged separately.
- Major scope changes require a revised agreement.
6. INTELLECTUAL PROPERTY RIGHTS
- Ownership of the final website/design transfers to the Client only after full payment.
- Anubhaw Enterprises retains the right to showcase completed work in its portfolio.
- Third-party tools, plugins, themes, or licenses remain subject to their original terms.
7. CONFIDENTIALITY
Both parties agree to keep confidential all proprietary, business, and technical information exchanged during the project.
8. WARRANTY & LIMITATION OF LIABILITY
- Services are provided “as is” and “as available.”
- We do not guarantee specific business results, rankings, or revenue.
- Our liability is limited to the total amount paid for the service.
- We are not responsible for losses caused by hosting providers, third-party tools, cyberattacks, or force majeure events.
9. TERMINATION
Either party may terminate the agreement with written notice:
- Payments for completed work remain non-refundable
- Advance payments are non-refundable once work has started
10. GOVERNING LAW & JURISDICTION (INDIA)
These Terms shall be governed by and construed under the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts in Bihar, India.
PART B – TERMS FOR INTERNATIONAL CLIENTS
11. SERVICES FOR INTERNATIONAL CLIENTS
Services provided are identical in scope to domestic services but delivered remotely across international borders using digital communication tools.
12. PRICING & PAYMENT (INTERNATIONAL)
- Payments shall be made in USD, GBP, EUR, or other agreed currency
- Payment methods may include international bank transfer, Wise, PayPal, or other platforms
- Client is responsible for any bank charges, currency conversion fees, or taxes imposed by their country
13. TAXES & COMPLIANCE
- Prices are exclusive of VAT, GST, withholding tax, or similar international taxes
- Any local tax obligations must be borne by the Client
- We do not provide tax or legal advice for international jurisdictions
14. INTELLECTUAL PROPERTY (INTERNATIONAL)
- Intellectual property transfers only after full payment
- Unauthorized resale, duplication, or redistribution of work is prohibited
- Open-source or third-party components remain governed by their respective licenses
15. DATA PROTECTION & PRIVACY
- Reasonable measures are taken to protect Client data
- The Client is responsible for compliance with local data protection laws (GDPR, etc.)
- We are not liable for breaches caused by third-party platforms or hosting providers
16. DISCLAIMER & LIMITATION OF LIABILITY
- No guarantees are made regarding market performance or profits
- Liability is limited to the amount paid by the Client
- We are not liable for indirect, incidental, or consequential damages
17. TERMINATION (INTERNATIONAL)
- Either party may terminate with written notice
- Fees paid are non-refundable for work already performed
- Outstanding invoices must be settled immediately upon termination
18. GOVERNING LAW & DISPUTE RESOLUTION (INTERNATIONAL)
- These Terms shall be governed by the laws of India
- Parties agree to attempt amicable resolution first
- Failing which, disputes shall be resolved under Indian jurisdiction
19. FORCE MAJEURE
Neither party shall be liable for delays or failure due to events beyond reasonable control, including but not limited to natural disasters, internet failures, government actions, pandemics, or war.
